Acceptance of Terms By accessing or using DigitalHain, you (“User,” “Customer,” or “Client”) agree to be bound by these Terms and Conditions, our Privacy Policy, and any other policies communicated to you. If you do not agree, you must not use the platform. 2. Services Provided DigitalHain offers businesses access to WhatsApp API functionalities, including but not limited to: Automated messaging Notifications and alerts Customer support via WhatsApp Integration tools for third-party systems We may update, modify, or discontinue any service at our discretion without prior notice. 3. Eligibility You may use DigitalHain only if: You are at least 18 years old. You have the authority to enter into a binding agreement. You comply with WhatsApp’s official Business Policy and Terms of Service. 4. User Responsibilities You agree to: Use DigitalHain only for lawful business purposes. Ensure compliance with WhatsApp’s policies. Provide accurate information during registration and maintain account security. Not send spam, unsolicited messages, or prohibited content. Be solely responsible for customer interactions conducted through the platform. 5. Account and Security You are responsible for safeguarding your login credentials. Any activity occurring under your account will be deemed authorized by you. Notify us immediately if you suspect unauthorized access. 6. Payments and Billing DigitalHain services may require subscription fees or usage-based charges. Payments must be made in full and on time as per the selected plan. All fees are non-refundable unless otherwise stated. Failure to pay may result in suspension or termination of services. 7. Data Privacy and Confidentiality We collect and process personal data in accordance with our Privacy Policy. We do not sell, rent, or misuse customer data. You retain ownership of your customer communications, but grant us the necessary license to process messages through our platform. 8. Restrictions on Use You agree not to use DigitalHain to: Violate laws, regulations, or WhatsApp’s policies. Harass, abuse, or defraud customers. Distribute malware, phishing links, or harmful content. Engage in bulk unsolicited messaging (“spam”). Violation may lead to immediate suspension or permanent termination of your account. 9. Intellectual Property DigitalHain, including its software, branding, and design, is owned by Cyberkida Digiera Pvt. Ltd. You may not copy, modify, distribute, or create derivative works without our prior written consent. 10. Limitation of Liability We provide services on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or completely secure services. Cyberkida Digiera Pvt. Ltd. shall not be liable for any indirect, incidental, or consequential damages, including loss of business, data, or profits. 11. Indemnification You agree to indemnify and hold harmless Cyberkida Digiera Pvt. Ltd. from claims, damages, liabilities, or expenses arising from your misuse of DigitalHain or violation of these Terms. 12. Termination We may suspend or terminate your account at any time for violations of these Terms. You may stop using the service at any time by contacting us at hi@digitalhain.com . Upon termination, your access to DigitalHain will be revoked, and associated data may be deleted as per our retention policies. 13. Governing Law and Jurisdiction These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram (HR). 14. Amendments We may revise these Terms and Conditions at any time. The Company reserves the right to modify, update, or change these Terms without prior notice. It is your responsibility to review this page periodically. Continued use of DigitalHain after changes constitutes acceptance of the updated Terms. 15.
