Acceptance of Terms By accessing or using DigitalHain ("Platform"), you ("User", "Client") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Cyberkida Digiera Pvt. Ltd. If you do not agree, please do not use our services. 2. Description of Service DigitalHain is a WhatsApp Business API SaaS platform that enables businesses to: Send and receive WhatsApp messages via the Meta WhatsApp Cloud API. Manage customer conversations through a multi-agent inbox. Run broadcast campaigns using Meta-approved message templates. Automate responses using chatbot flows. Manage WhatsApp Business Account settings and templates. 3. Eligibility You must be at least 18 years of age and legally authorized to enter into contracts under Indian law to use DigitalHain. By using our platform, you represent that you meet these requirements. 4. Account Registration You agree to provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account. Notify us immediately at hi@cyberkida.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts with false or misleading information. 5. Acceptable Use Policy You agree to use DigitalHain only for lawful purposes. You must NOT: Send spam, unsolicited messages, or bulk messages to users who have not opted in. Violate Meta's WhatsApp Business Policy or WhatsApp Commerce Policy. Send content that is illegal, abusive, threatening, defamatory, or obscene. Use the platform to impersonate any person or entity. Attempt to gain unauthorized access to our systems or other users' accounts. Reverse engineer, decompile, or tamper with the platform. Resell or sublicense access to the platform without written permission. Use the platform for any activity that violates applicable Indian laws. Violation of this policy may result in immediate account suspension without refund. 6. WhatsApp & Meta Compliance As a user of DigitalHain's WhatsApp API integration, you additionally agree to: Comply with Meta's Terms of Service, WhatsApp Business Policy, and Commerce Policy. Only send messages to users who have explicitly opted in to receive WhatsApp communications from you. Use only Meta-approved message templates for outbound messaging. Not use the platform for sending prohibited content as defined by Meta. Accept that Meta may independently suspend or restrict your WhatsApp Business Account for policy violations — DigitalHain is not responsible for such actions by Meta. 7. Subscription & Payments DigitalHain offers subscription-based plans billed monthly or annually. Payments are processed via Razorpay in Indian Rupees (INR). Subscriptions auto-renew unless cancelled before the renewal date. Failure to pay may result in service suspension as described in our Refund & Payment Policy. Intellectual Property All content, features, code, design, and branding on DigitalHain are the exclusive property of Cyberkida Digiera Pvt. Ltd. You may not copy, reproduce, distribute, or create derivative works without our prior written consent. Your data and content remain your property. By using our platform, you grant us a limited license to process your data solely for the purpose of providing our services. 9. Limitation of Liability To the maximum extent permitted by law: DigitalHain is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from use of the platform. We are not responsible for downtime, data loss, or service interruptions caused by Meta, Razorpay, Hostinger, or other third parties. Our total liability to you shall not exceed the amount you paid to us in the 3 months preceding the claim. 10. Service Availability We strive to maintain platform availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance wherever possible. We are not liable for downtime caused by factors outside our reasonable control including third-party API outages (Meta, Razorpay). 11. Termination We reserve the right to suspend or terminate your account at any time for: Violation of these Terms or our Acceptable Use Policy. Non-payment of subscription fees. Fraudulent or abusive behavior. Request by Meta or law enforcement authorities. You may terminate your account at any time from your dashboard. Upon termination, your data will be retained for 30 days and then permanently deleted. 12. Governing Law & Disputes These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in [Your City — e.g., Ghaziabad / Delhi], Uttar Pradesh, India. We encourage resolving disputes amicably by contacting hi@cyberkida.com first. 13. Changes to Terms We may update these Terms at any time.
